Justice for Darfur’s victims mired in political expediency – ICC prosecutor



17 June 2014 – Challenging the Security Council to take immediate action to protect victims in the ongoing Darfur crisis, the Prosecutor of the International Criminal Court (ICC) underscored today that without concrete steps to apprehend those accused of crimes against humanity, the world’s efforts to ensure justice in Darfur could “go down in history as an indefensible failure.”

“What have we achieved in concrete terms? Have we lived up to the expectations of Darfur's victims? Sadly, the intellectually honest answer is a resounding ‘no,’” Fatou Bensouda said as she began her briefing to the Council with a look back over the nearly 10 years since it had referred the situation in Darfur to the Hague-based Court.

Finding no cause for celebration, especially since no steps have been taken regarding the arrest and surrender of a number of high profile indictees, including Sudanese President Omar Al Bashir, she said, the “sad reality is that action from this Council has not been forthcoming when it mattered most for Darfur’s victims.”

And while the ICC may have significantly contributed to raising awareness about the massive and systematic crimes committed in Darfur, the Court’s best contribution to ending impunity through a judicial process that independently, fairly and impartially assess the evidence and determines guilt or innocence has yet to be achieved. Indeed, continued Ms. Bensouda: “The ICC’s judicial process cannot take place without arrests. Darfur suspects remain at large and no meaningful steps have been taken to apprehend them and bring them to justice.”

“Today we are in the same position as we were in 2007”, she said, following the Council’s “much-lauded” referral of the case to the Court and the issuance of arrest warrants for Ahmad Harun and Ali Kushayb, and, subsequently, President Bashir, who continues to travel in defiance of the warrants, including to States party to the Court’s founding Rome Statute.

“This reflects badly, not just on the international justice system of which the ICC is only a part, but it also greatly undermines the credibility of this Council as an instrument of international peace and security,” said Ms. Bensouda, adding that it is high time for Sudan’s ongoing defiance of Security Council resolutions to be matched by the Council’s decisive action.

Darfur’s victims are looking to the Council for answers to critical questions, she continued: For how much longer will legality and accountability be sacrificed at the altar of political expediency?; and What amount of suffering should Darfur's victims endure for this Council to act decisively on the situation in Darfur?

Drawing the Council’s attention to another important issue, she said recent allegations that reporting of the African Union-United Nations Mission in Darfur (UNAMID) has been subject to manipulation, with the intentional effect of covering up crimes committed by the Sudanese Government, “should be a matter of concern for us all.”

Those allegations call for thorough, independent and public enquiry, Ms. Bensouda said, noting that while the responsibility for this manipulation may lie with a handful of individuals, it impugns the credibility of the Mission as a whole and deprives advocates of peace and justice of an essential tool for evaluating the ever evolving situation in Darfur.

“Victims in Darfur and the peacekeepers who have sacrificed their lives deserve better. We all do,” she declared, expressing the hope that the Council and the wider UN take immediate and concrete steps to establish the full facts and take appropriate action if the allegations prove to be well-founded.

As for the current situation on the ground in Darfur, she expressed “deep concern” over the increasing violence and the immense number of people who continue to be displaced. “I likewise deplore the increasing constraints placed on those who are trying to aid the displaced…the deliberate obstruction of humanitarian aid must end.”

Equally concerning is the on-going patterns of aerial bombardments and armed attacks on civilian populations by militia/Janjaweed, and in particular, the involvement of the newest iteration of the Janjaweed, the Rapid Support Forces, led by Mohamed Hamdan.

“It is particularly disturbing that in February this year, the Rapid Support Forces shifted their operations from North Kordofan to Darfur,” noted Ms. Bensouda, stressing that her Office's factual indicators seem to illustrate a similar pattern of indiscriminate and disproportionate attacks against civilians by the Rapid Support Forces. In all of the reported attacks, crimes against civilians were allegedly committed from the end of February, onwards, coinciding with the deployment of the Rapid Support Forces to Darfur.

Overall, she called for a dramatic shift in the Council’s approach to arresting Darfur suspects, especially since the Sudanese Government “has consistently failed” to carry out its primary responsibility to implement the outstanding arrest warrants. I believe that concerted efforts to promote cooperation with the Court may fill the gap,” she said, calling on States and the Council to find creative ways to supports “those amongst them that may be most vulnerable” to planned visits by President Bashir or other indictees.

Dödsdömda Meriam i Sudan befinner sig fortfarande i fängelse och nu nekas hennes man att besöka henne.
   – Sverige måste sätta press på regimen i Sudan för att få henne fri, säger Ayman Adel Amin på Human Rights Organization Sudan.

Organisationen följer fallet med Meriam Yenhya Ibrahim som uppmärksammats världen över. Den 27-åriga kvinnan var höggravid då domen föll och hon har sedan tvingats föda i fängelset, utan tillgång till vård. Bland annat har Storbritanniens premiärminister David Cameron uttalat kritik mot Sudan, men från svenskt håll har det varit tyst, vilket Ayman Adel Amin beklagar.
– Det går att påverka Sudan. Layla Ibrahim som också var dödsdömd släpptes fri sedan världen satt press på regimen, säger han.
Det var i juli 2012 som 23-åriga Layla Ibrahim dömdes till döden genom stening för äktenskapsbrott. Hon fängslades tillsammans med sitt nyfödda barn men frigavs efter protester.

Maken förbjuden att besöka fängelset

I slutet av maj väcktes hopp även för Meriam Yenhya Ibrahim då en tjänsteman på utrikesdepartementet i Sudan sa till BBC att hon skulle släppas fri inom några dagar, men sedan har inget hänt.
– Det är de konservativa grupperna i landet som håller emot och de har mycket makt. De gick ut några dagar efter BBC-uttalandet i nationell teve och sa att hon blir kvar i fängelset, berättar Ayman Adel Amin.
Han har också fått rapporter om att Meriams man nu förbjudits att besöka sin fru och sitt nyfödda barn, vilket han kunnat göra tidigare.

Ska ställa fråga till Carl Bildt

Ayman Adel Amin på Human Rights Organization, som på alla sätt vill få Sverige att uttala kritik, lever i Sverige och träffade i förra veckan riksdagsledamoten Amineh Kakabaveh (V) för att diskutera fallet. Amineh Kakabaveh har berörts av historien om Meriam och ger nu löften om att agera. Hon kommer i veckan att ställa en fråga i riksdagen till utrikesminister Carl Bildt.
– Jag vill veta vad Sverige kan göra för att stoppa dödsdomen. Det är barbariskt och det är en medeltida lag som styr. Sverige är känt som världens mest jämställda land och borde kunna vara en betyda röst i de här frågorna, säger hon.
Amineh Kakabaveh är aktiv i organisationen Varken hora eller kuvad och planerar även att skriva ett brev till Jan Eliasson, vice generalsekreterare i FN.
– Meriam är bara ett fall bland många. Runt om i världen behandlas kvinnor så här. Det är ett krig mot kvinnor som pågår och FN borde agera, säger hon.

وشدَّد المذكرة على المطالبةً بوقف تنفيذ حكم الإعدام بحق الطبيبة مريم، وإطلاق سراحها فوراً، وإلغاء حكمي الردة والزنا الصادران في حقها، وإتخاذ موقف أكثر قوة للتصدي للهجوم على الحريات العامة في السودان.
وإلتقى منسق المنظمة أيمن عادل أمين بعضو من البرلمان السويدي (مينا كاكابافتش) في مبني البرلمان بالعاصمة ستكهولم، وقدم تنويراً عن أوضاع حرية الصحافة والتعبير، والتضييق علي الحريات العامة، وإنهيار مساحة الحريات الدينية والسياسية، وزيادة الهجمة الأمنية علي الصحفيين، والإعتقالات العشوائية، وأساليب التعذيب التي يستخدمها جهاز الأمن مع المعتقلين.
وندد أيمن عادل أمين بقرار رفض تسجيل الحزب الجمهوري، وإعتقال السياسيين على رأسهم محمد صلاح وآخرين.
وطالب أيمن عادل أمين بتكثيف الضغط علي السلطات السودانية لوقف الإعتقالات، وتشكيل لجنة مستقلة للتحقيق في قتلى التظاهرات سبتمبر من العام الماضيـ إلى جانب الكشف عن نتائج التحقيقات السابقة والخطوات قامت بها لتوفير العدالة للضحايا.

Rapid Support Forces are the NCP recycled Janjaweed

May 21, 2014 - Rapid Support Forces (RSF) is the nickname for the same infamous notorious Janjaweed militias that the National Congress Party (NCP) regime utilised as a proxy to commit the heinous crimes of war, crimes against humanity and genocide in Darfur in the years 2004-2005. It is a substitute for the proper name Janjaweed or it is just a misnomer for disinformation and deception. The real name Janjaweed would alienate and associates it with the reprehensible crimes perpetrated against the people of Sudan in Darfur.

The alleged (RSF) is the recycled Janjaweed militia representing the arm of the (NCP) regime’s National Intelligence and Security Services (NISS) for quelling the rebellion and suppressing revolution and civil disobedience and committing a second wave of genocide in Darfur. The joint Hybrid United Nations and African Union Mission to Darfur (UNAMID has been erased the term Janjaweed from its official reports under the bullying tactics of coaxing and intimidation of the NCP régime, according to the “Special Interview” of Ms. Aisha al-Basri, former UNAMID spokesperson with the al-Arabiya Television Channel in April 2014. Now, the two more pleasant/desirous terms of Rapid Support Force (RSF) and Rapid Respond Force (RRF) replaced the revolting/repulsive Word Janjaweed. That Intrigue failed to fool neither the acumen of the Sudanese citizens nor the regional and global media.

These forces operate as an arm for the security service that replaced the Sudanese armed forces (SAF) which the NCP regime has increasing doubts about their loyalty, sincerity and obviously has no full trust in it. The RSF Commander Major General Abbas Abdul-Aziz said in a televised statement that the majority of the members in the (RSF/RRF) are Darfurians who usually adored military service and love engaging in the armed forces. That formal statement of the Major General Abdul-Aziz confirms that the constitution of the (RSF) formed essentially by the infamous Janjaweed militias. By the way this Major General Abbas Abdul-Aziz is from the town of Matamma, in the Northern Nilotic region. He is a person entrusted by Omer al-Bashir as a close relative. Furthermore, Abdul-Aziz is a NISS officer and his leadership for the (RSF) is more ceremonial. As a proof for that, Abdul-Aziz refrained from speaking about the accusations made against the leader of the National Umma Party (NUP) instead Hemeti or his double/impostor ordered to condemn the statements attributed to the (NUP) and saying that the allegations against his (RSF) are bags of lies. He shouted in anger at the press conference. Consequently, leader on the (RSF) Abdul-Aziz has been relieved from the critical responsibility and embarrassment of getting involved in the condemnation of the National Umma Party leader.. Thus, Hemeti played the role of his master’s voice through the NCP Media outlet.
The formation of the (RSF) followed the statement of the fugitive from the international justice, the Génocidaire the NCP President, Omer Hassan Ahmed al-Bashir who declared that his SAF will put an end to insurgency/Rebellion before the end of the year 2013/2014 through the so-called ‘Hot Summer Plan’. Accordingly, the NCP regime sought improving its relationship with the Janjaweed leader Mohammed Hamdan Daglo, better known as Hemeti. Hemeti
descends from the Mahiriya branch of the Northern Rizeigat Arabs Tribe. He used to blame the NCP regime for the preferential treatment of his archrival Musa Abdalla Hilal, who descends from the Um Jalloul branch of the Northern Rizeigat Tribal group and occupies the position of Advisor to al-Bashir at the Presidential Palace in Khartoum. At this juncture, one has make the following note; We must acknowledge and admit here that the two tribes Mahariya and Um Jalloul are respected and honored tribal groups in Darfur who have Native Administrations under the leadership of their Sheikhs who worked tirelessly to repair the social fabric of the components of the Darfur tribes. But unfortunately figures or members of them, such as Musa Hilal and Mohammed Hamdan favoured involvement in crime under the lure of money and jobs and allowed themselves to be exploited by the Government of National Congress Party (NCP) to hurt their fellow citizens and their neighbors.. Thus, the NCP regime accepted all the conditions of Hemeti in lieu for counter-insurgency campaign in Darfur. As expected, his unleashed troops went berserk, burning 35 villages in the south east of Nyala. The villages targeted include Hijer Tunjo, Afouna, Baraka Tuli, Tukumari, Um Gounja, Thani Dileiba, and Hameidia. The so-called (RSF) militias, in addition, looted traders’ properties, indiscriminately killing unarmed civilians, terrorizing and displacing the survivors into the middle of nowhere, besides other heinous crimes including rape. It worth noting that the same (RSF) militia led by Hemeti committed atrocities in North Kordofan especially in the capital El-Obeid. However, his militias suffered crushing defeats at the hand of the Sudanese Revolutionary Forces (SRF) represented by the Sudanese Justice and Equality Movement (JEM). The (RSF) led by Hemeti decided after the defeats to head to Darfur for a revenge by wreaking havoc targeting the civilian populations rather than facing the armed Darfuri rebels. The Janjaweed militias in their modern version are given the new name of (RSF/RRF). Hemeti is very similar to the previous Janjaweed leader, Shukralla who was killed in a battle with the Darfuri rebels. Abbas Abdu-Aziz the close aides of Omer al-Bashir who climbed fast to the top was the mastermind in mobilizing the Janjaweed militia under the new title (RSF). Major General Abbas Abdul Aziz played the role of Comparsa in this setting. The word Comparsa is an Italian word in the movies indicating a person who plays a secondary marginal role in the film. He has used Hemeti and the ilk as tools and proxies as the usual policy of the NCP regime in dealing with the Darfur issue.

On a related subject that is not possible to bypass is the U.N.-African Union Mission in Darfur (UNAMID)’s silence of reporting the heinous crimes committed by the Janjaweed militias and the mercenaries that the (NCP) regime brought from the neighbouring West African States and deployed in Darfur for its new wave of Genocide. The World will continue wondering as to why the inaction of the United Nations Security Council (UNSC) over the silence of (UNAMID) in reporting the atrocities it witnesses.
